Terms of Service

These Terms of Service ("Terms") govern your access to and use of pubgenius (the "Service"), operated by pubgenius Inc.("pubgenius," "we," "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

pubgenius is a web-based platform that lets venue operators host live trivia games. Operators create question sets (including with AI assistance), display a host screen, and let patrons join and play from their own devices. We may change, suspend, or discontinue features at any time while the product is in active development.

2. Accounts & Eligibility

You must be at least 18 years old and able to form a binding contract to create an operator account. Accounts and authentication are handled through our identity provider. You are responsible for activity under your account and for keeping your credentials secure.

3. Acceptable Use

You agree not to misuse the service, including: violating any law; infringing others' rights; uploading or generating unlawful, hateful, or infringing content; attempting to disrupt or reverse-engineer the service; or using it to harass others. We may suspend accounts that violate these Terms.

4. Content & AI-Generated Questions

The service can draft trivia questions using AI. AI output can be inaccurate or inappropriate. You are solely responsible for reviewing and approving any question set before displaying it to patrons. You retain responsibility for all content you publish through the service, and you grant us a license to host and display that content for the purpose of operating the service.

5. Intellectual Property

The service, including its software, design, and branding, is owned by pubgenius Inc. and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the service. You keep ownership of content you create.

6. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free.

7. Limitation of Liability

To the fullest extent permitted by law, pubgenius Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the service. Our total liability for any claim will not exceed the greater of the amounts you paid us in the prior twelve months or USD $100.

8. Termination

You may stop using the service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Provisions that by their nature should survive termination will survive.

9. Changes to These Terms

We may update these Terms as the product evolves. Material changes will be reflected by updating the date above. Continued use after changes take effect constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. pubgenius Inc. is a Delaware corporation.
